Returns, Refunds & Exchanges Policy
1. General
PrimeShift sells consumer lifestyle, kitchen, beverage and electronic accessories intended for personal and household use. Customers are encouraged to review all product descriptions, specifications, compatibility information, charging requirements, usage guidelines and safety instructions carefully before purchasing.
Our current product range includes items such as automatic stirring protein shaker cups and rechargeable electric wine bottle openers and related accessories. PrimeShift may add additional products to its range from time to time.
Certain products that have been used, opened, damaged, contaminated or altered may not qualify for a change-of-mind return, subject always to the customer's rights under applicable South African consumer law.
Products that are defective, unsafe, incorrectly supplied or damaged may qualify for a repair, replacement or refund in accordance with applicable law and this policy.
2. Cooling-Off Period: Direct Marketing
In terms of the Consumer Protection Act, a cooling-off period applies to qualifying transactions resulting from direct marketing.
Direct marketing may include certain sales resulting from direct promotional contact by telephone, email, WhatsApp or other direct communication.
Where the transaction qualifies as direct marketing under applicable law, the customer may cancel the transaction within 5 business days after the later of the date on which the transaction was concluded or the goods were delivered, subject to the Consumer Protection Act.
Where goods have already been delivered, the customer must return the goods to PrimeShift in accordance with applicable law.
Where applicable, returned products should be:
-
unused;
-
in their original condition;
-
complete with all components and accessories;
-
in their original packaging where reasonably possible; and
-
not damaged, altered, misused or contaminated.
Any refund due under an applicable direct-marketing cooling-off right will be handled within the period required by South African law.
3. Online Purchases and Cooling-Off Rights
For ordinary online purchases that are not direct-marketing transactions, PrimeShift does not automatically provide additional change-of-mind rights beyond those required by applicable South African law.
However, where the Electronic Communications and Transactions Act 25 of 2002 applies to an eligible electronic transaction, the customer may have the right to cancel the transaction within 7 days after receiving the goods, subject to the exclusions and requirements contained in that Act.
Where this statutory cooling-off right applies:
-
the customer must notify PrimeShift of the cancellation;
-
the customer must return the goods;
-
the customer may be responsible for the direct cost of returning the goods; and
-
any refund will be processed within the period required by applicable law.
Certain goods or transactions may be excluded from statutory cooling-off rights under applicable legislation.
Nothing in this policy is intended to limit any statutory right that a customer may have.
4. Defective Products: CPA Section 56 Warranty
Where applicable, products sold by PrimeShift carry the 6-month implied warranty of quality provided for under the Consumer Protection Act.
If, within 6 months after delivery, a product fails to meet the standards required by the Consumer Protection Act because it is defective, unsafe, not reasonably durable or otherwise fails to meet applicable quality requirements, the customer may be entitled, subject to the Act, to choose an appropriate remedy including:
-
repair;
-
replacement; or
-
refund.
PrimeShift may reasonably inspect, test or assess the product to determine the nature and cause of the reported defect.
Where a valid claim exists under the Consumer Protection Act, PrimeShift will comply with the remedies and obligations required by applicable South African law.
5. Exclusions: Wear, Tear, Damage & Misuse
The implied warranty or other product guarantees may not apply where the problem results from circumstances such as:
-
normal wear and tear;
-
accidental or intentional damage;
-
incorrect, unsafe or excessive use;
-
failure to follow product instructions;
-
improper cleaning or storage;
-
exposure to excessive heat, water, moisture or other conditions where the product is not designed for such exposure;
-
tampering with or modifying the product;
-
using an incorrect charger, power supply or charging method;
-
electrical damage caused by misuse or an unsuitable power source;
-
using the product for purposes other than its intended purpose; or
-
damage caused after delivery through circumstances unrelated to a manufacturing or product defect.
Customers should follow all instructions supplied with the product, particularly instructions relating to charging, electrical components, cleaning, food-contact surfaces and safe operation.
These exclusions do not remove any rights that cannot lawfully be excluded under South African consumer protection legislation.
6. Hygiene, Food Contact & Safety
Products such as protein shaker cups and other drinkware come into contact with food, beverages or the user's mouth.
For hygiene and safety reasons, PrimeShift may not accept a change-of-mind return of a product that has been used or contaminated where refusal of such a return is permitted by applicable law.
Examples may include products that:
-
have been used for food, protein powder or beverages;
-
have been drunk from;
-
contain food, beverage or other residue;
-
have been improperly cleaned;
-
show signs of contamination;
-
have been damaged or altered after delivery; or
-
are missing components, seals, packaging or accessories.
This hygiene restriction does not remove a customer's statutory rights where the product is defective, unsafe, incorrectly supplied or otherwise protected under applicable South African law.
Electrical components must not be submerged in water unless the product instructions specifically state that they are designed for such use.
7. Incorrect or Damaged Deliveries
If you receive:
-
an incorrect product;
-
the incorrect quantity;
-
a product that appears to have been damaged during delivery; or
-
an order with missing parts or accessories,
please contact PrimeShift as soon as reasonably possible.
We recommend notifying us within 48 hours of delivery where possible and providing clear photographs or video evidence. Prompt reporting helps us investigate the issue with the courier or supplier.
Failure to report an issue within 48 hours does not remove any rights that you may have under applicable South African consumer law.
If the issue is confirmed, PrimeShift may arrange an appropriate replacement, exchange, collection or refund at no additional cost to the customer where required.
8. Refunds
Approved refunds will generally be issued using the original payment method where reasonably possible.
The time required for a refund depends on the reason for the return and the applicable legal requirements.
For qualifying direct-marketing cancellations, electronic-transaction cooling-off cancellations and statutory defective-product claims, PrimeShift will process refunds within the time period required by applicable South African law.
After PrimeShift has issued a refund, your bank, card provider or payment processor may require additional processing time before the funds appear in your account.
Original delivery charges and return shipping costs may be non-refundable where permitted by law.
Where a return is caused by a defective, damaged or incorrectly supplied product and PrimeShift is legally responsible for the associated costs, the appropriate delivery or return costs will be handled in accordance with applicable law.
9. Returns Procedure
Before returning a product, please contact PrimeShift at:
Email: primeshiftsupport@gmail.com
Please provide:
-
your order number;
-
your full name;
-
the product concerned;
-
the reason for the return;
-
a description of the problem, where applicable; and
-
photographs or videos where relevant.
PrimeShift may provide return instructions or request additional information before the product is sent back.
Please do not send a return without first contacting us, as this may delay the processing and identification of your return.
10. Limitation of Liability
To the extent permitted by South African law:
-
PrimeShift is not responsible for loss, injury or damage caused by the incorrect, unsafe or improper use of a product;
-
customers are responsible for following all product instructions, charging instructions, warnings and safety information;
-
electrical products must be used with suitable charging equipment and according to their stated specifications;
-
drinkware and food-contact products must be properly cleaned and maintained;
-
products must only be used for their intended purpose; and
-
PrimeShift is not responsible for damage caused by unauthorised alterations, modifications, repairs or misuse.
PrimeShift's products are consumer lifestyle products and must not be used in a manner inconsistent with their instructions or intended purpose.
Nothing in this section excludes or limits liability or consumer rights where such exclusion or limitation is prohibited by South African law.
11. Governing Law
This policy is governed by the laws of the Republic of South Africa.
It should be read together with applicable South African consumer protection legislation, including the Consumer Protection Act 68 of 2008 and, where applicable, the Electronic Communications and Transactions Act 25 of 2002.
Nothing contained in this policy is intended to exclude, restrict or remove any consumer right that cannot legally be excluded under South African law.
